1. Who can use this
You may use the service if you are at least 18 years old and have authority to enter into this agreement on behalf of yourself or the company you represent. We do not knowingly collect personal data from anyone under 16, see the Privacy Policy.
2. What the service does
We provide email list validation and deliverability guidance. Today, you send us a list (by a private link or by email) and we run checks against each address and return a verdict per address, Inbox, Caution or Remove. We also publish free guides you can read without getting in touch.
3. Acceptable use
Do not use the service to:
- validate lists you did not lawfully obtain (no scraped data, no purchased lists without a lawful basis);
- probe or attack our infrastructure or other users;
- reverse-engineer the scoring to replicate the service;
- break any law that applies to you, including spam law (CAN-SPAM, CASL, GDPR) and consumer protection law.
We can decline or stop work that violates this. For serious or repeat violations we will tell you why.
4. Your data
The lists you send us remain yours. We process them on your behalf under the Privacy Policy.
5. Payments and refunds
We agree the price with you before any work starts, and we do not charge more than the price we quoted. Card payments are processed by Stripe.
If we cannot deliver the results you paid for, we refund you in full. Once results are delivered, the work is done and is not refundable, but the bounce-back guarantee still applies: if we marked an address Inbox and it hard-bounces, we credit you what you paid for it. Nothing here limits your statutory rights.
6. Intellectual property
The service, the brand and the content we publish are ours. Your lists, your verdicts, and any content you submit remain yours. You grant us a limited licence to process your content so we can deliver the service to you.
7. Warranties and disclaimers
We work hard on the service. We do not warrant that it will be error-free or uninterrupted. Validation verdicts are advisory, you are responsible for the sending decisions you make with them. Nothing in this section limits your statutory rights as a consumer where those rights cannot be excluded by contract.
8. Limitation of liability
To the extent permitted by law, our total liability to you for any claim arising out of or in connection with this agreement is limited to the amount you paid us in the 12 months before the event giving rise to the claim. We are not liable for indirect, incidental or consequential losses, except where applicable consumer protection law says we are.
9. Termination
You can stop working with us any time by emailing daniel@listgevity.com. We can stop providing the service for serious breach of these terms or where we are required to by law. We will explain why.
10. Partner program
If you refer clients to us as a partner, these rules apply on top of the rest of these terms:
- We pay the commission rate in your written partner agreement. If you do not have one, we pay the rate shown on our pricing page, currently 15%.
- Commission is paid on what the client you referred actually pays us, after any refunds and guarantee credits, for as long as they stay a paying customer and you stay a partner in good standing.
- We can change or end the partner program, including the rate, by giving you 30 days' notice by email. A change never reduces commission you have already earned.
- We do not pay commission on self-referrals, or on referrals won through spam or misleading claims about us.
- Earnings shown in our calculator are illustrations, not a promise of what you will earn.
11. Changes to these terms
We can update these terms. For material changes we will email you and update the "Last updated" stamp at the bottom. Continued use after a material change counts as acceptance.
12. Governing law and forum
This service is operated by Transcend Enterprise Ltd (company number 15179043), registered in England and Wales. These terms are governed by the laws of England and Wales, without regard to its conflict of laws principles.
EU, UK, and Swiss consumers: nothing in this section deprives you of the protection afforded by mandatory provisions of the law of the country in which you have your habitual residence, including the right to bring proceedings in the courts of that country.
